RELATING TO TIME SHARING.

Allows an escrow agent to release purchasers' funds to a developer prior to closing if the developer secures the funds with a bond or letter of credit.

RELATING TO TIME SHARING.

Adds definitions of "master development" and "person" and amends the definitions of "blanket lien" and "project" in the Time Sharing Plans law.

RELATING TO MORTGAGE BROKERS AND SOLICITORS.

Exempts the sales agent of a time share plan developer from mortgage broker and solicitor licensing laws, if the developer is a licensed mortgage broker.

RELATING TO TIME SHARE PLANS.

Redefines "developer" in the time share law to exclude a person owning not more than 12 time share interests who did not create the plan and offers it for resale, and an association employing a third party to sell its time share interests acquired for non-payment of assessments.

RELATING TO NATURAL DISASTERS.

Authorizes Hawaii hurricane relief fund moneys to be used for (1) other natural disasters such as flood, tsunami, and lava flow; and (2) grants to individuals who install wind resistive devices in their residences.

RELATING TO INSURANCE.

Requires allegations of Insurance Code violations to be filed and heard by the Insurance Commissioner. Allows the Commissioner to award restitution as a remedy through an administrative hearing.

Repeals the provision that allows pooled insurance to be limited to constuction projects that are estimated to cost $50,000,000 or more.

RELATING TO INSURANCE.

Conforms certain insurance provision with federal law and national standards.

RELATING TO SENTENCING OF REPEAT OFFENDERS.

This measure will toughen the penalties imposed upon those individuals who repeatedly commit felony crimes by specifying that anyone committing felony insurance fraud in motor vehicle insurance, private health insurance, health maintenance organization health insurance, and worker's compensation insurance lines will be subject to repeat offender increased sentencing guidelines for having previously committed the crime of felony insurance fraud.
