RESOLUTION
AUTHORIZING DESIGNATION OF AN INDUSTRIAL PARK.
WHEREAS, section 171-134, Hawaii Revised Statutes (HRS), allows the Department of Land and Natural Resources (Department) to develop an area of public lands as an industrial park after the area is designated as an industrial park in accordance with section 171-132, HRS; and
WHEREAS, section 171-132, HRS, provides that a contiguous area of not less than five acres of public lands which is classified and determined by the Board of Land and Natural Resources (Board) as suitable and economically feasible for industrial use may be designated as an industrial park by a resolution adopted by the Board and approved by the Legislature by concurrent resolution; and
WHEREAS, the Department desires to designate as an industrial park approximately forty-five acres of contiguous public lands located at Kaholaloa, Sand Island, Honolulu, Oahu, Hawaii, identified as Tax Map Keys (1) 1-5-41: 334 and portions of 6, 22 and 130 (subject area); and
WHEREAS, on September 12, 2003, under agenda item D-14, the Board approved the designation of the subject area as an industrial park; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2005, the House of Representatives concurring, that the Board of Land and Natural Resources is authorized to designate public lands located at Kaholaloa, Sand Island, Honolulu, Oahu, Hawaii, identified as Tax Map Keys (1) 1-5-41: 334 and portions of 6, 22 and 130, as an industrial park; and
BE IT FURTHER RESOLVED that the the Board is authorized to withdraw portions of the subject area from the designation as an industrial park if the Board determines that such portions are not feasible for development as part of the industrial park, subject, however, to the requirement contained in section 171-132, HRS, that the remaining designated area be at least five contiguous acres in size; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board.
