A BILL FOR AN ACT

 

relating to state funds.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that expenditures from the emergency and budget reserve fund established by section 328L-3, Hawaii Revised Statutes, are needed to meet the emergency economic situation currently facing the State. The legislature determines that the moneys are urgently needed to maintain levels of programs that are essential to the public health, safety, and welfare. The legislature further finds that the grants and subsidies under this Act are in the public interest and serve the public health, safety, and welfare.

SECTION 2. There is appropriated out of the emergency and budget reserve fund the sum of $       or so much thereof as may be necessary for fiscal year 2005-2006 and the same sum or so much thereof as may be necessary for fiscal year 2006-2007 as a purchase of service pursuant to chapter 103F, Hawaii Revised Statutes, to provide treatment services for child victims of intrafamilial sexual abuse, including psychological treatment and case management services for child victims and their families who are not covered under the child protective services system of the department of human services.

The sums appropriated shall be expended by the judiciary via the children's justice center in accordance with chapter 103F, Hawaii Revised Statutes, for the purposes of this section.

SECTION 3. There is appropriated out of the emergency and budget reserve fund the sum of $         or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $         or so much thereof as may be necessary for fiscal year 2006-2007 as a purchase of service pursuant to section 103F, Hawaii Revised Statutes, for the purpose of providing direct medical care to the uninsured.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 4. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a purchase of service pursuant to chapter 103F, Hawaii Revised Statutes, for the provision of sexual assault direct services throughout Hawaii.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 5. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the same sum or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for a full-time dentist for the mobile care vans of the Office of Social Ministry's Mobile Care Health Project.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 6. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the same sum or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, to provide critical food, housing, and transportation assistance to eligible HIV/AIDS patients who can no longer be supported by federal CARE Act funding and to ensure that related programs such as FoodBasket and Gregory House continue.

The sums appropriated shall be expended by the department of health for the purposes of this section to be used to provide food, housing, and transportation assistance for eligible HIV/AIDS patients. The department of health shall contract with individuals and agencies that receive or have received, and are eligible for, federal CARE funding to provide such services.

SECTION 7. There is appropriated out of the emergency and budget reserve fund the sum of $          or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $          or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for emergency medical services at the Waianae Coast Comprehensive Health Center.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 8. There is appropriated out of the emergency and budget reserve fund the sum of $           or so much thereof as may be necessary for fiscal year 2005-2006 and the same sum or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for The Queen's Medical Center to pay for the costs it incurs to compensate physicians to be on-call to provide trauma and emergency medical services; provided that The Queen's Medical Center shall accept, immediately and on a continuing basis, patients from the other islands needing trauma care, whether or not those patients are transferred from another medical facility on another island and whether or not they are insured. The department of health shall obtain assurances from The Queen's Medical Center for purposes of this section prior to and during the release of any funds. The department of health shall monitor The Queen's Medical Center for compliance with this section. If The Queen's Medical Center breaches its assurance, then the department of health shall cease to release the appropriation.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 9. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, to Na Lei Wili Area Health Education Center's Grow Our Own Healers Youth Program and Health Corps Hawaii to address workforce shortages through tiered mentoring, health care exploration, community health education, and community service.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 10. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Catholic Charities of the Diocese of Honolulu for the Lanakila Multi-Purpose Senior Center.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 11. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for the senior center program at the Moiliili Community Center.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 12. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for the senior center program at the Waikiki Community Center.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 13. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 to establish and operate a school-based student health services project, as a collaborative project of the departments of health, education, and human services.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 14. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 for the provision of sexual assault direct services throughout Hawaii.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 15. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Coalition for a Drug Free Hawaii for the Strengthening Hawaii Families Program to prevent substance abuse among youth in the Koolauloa area.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 16. There is appropriated out of the emergency and budget reserve fund the sum of $ or so much thereof as may be necessary for fiscal year 2005-2006 and the same sum or so much thereof as may be necessary for fiscal year 2006-2007 to be deposited into the emergency medical services special fund to establish a twenty-four hour, seven days a week, rapid response emergency medical services unit for the Mililani and Mililani Mauka areas on Oahu.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 17. There is appropriated out of the emergency and budget reserve fund the sum of $ or so much thereof as may be necessary for fiscal year 2005-2006 and the same sum or so much thereof as may be necessary for fiscal year 2006-2007 as a grant-in-aid for an additional third shift of ambulance service at the Makakilo ambulance unit.

The sums appropriated shall be expended by the city and county of Honolulu for the purposes of this section.

SECTION 18. There is appropriated out of the emergency and budget reserve fund the sum of $ or so much thereof as may be necessary for fiscal year 2005-2006 and the same sum or so much thereof as may be necessary for fiscal year 2006-2007 as a grant-in-aid to the city and county of Honolulu to study the need, cost, and placement site for a permanent emergency medical services hub for the Mililani and Waipio Gentry areas on Oahu.

The sums appropriated shall be expended by the department of emergency services of the city and county of Honolulu for the purposes of this section.

SECTION 19. There is appropriated out of the emergency and budget reserve fund the sum of $ or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, to pay for technology, acquisition, expansion, or upgrading of facilities and equipment necessary to provide dental services at federally qualified health centers.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 20. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 for the purpose of supporting and expanding the nursing home without walls program so that this program can continue to provide high quality elder care-related services to Hawaii's elderly population.

The sums appropriated shall be expended by the department of human services for the purposes of this section.

SECTION 21. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 for the purpose of supporting and expanding the chore services program so that this program can continue to provide high quality elder care as well as disabled services to Hawaii's elderly and disabled populations.

The sums appropriated shall be expended by the department of human services for the purposes of this section.

SECTION 22. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Youth Services Network for its Transitional Living Program for Unserved Street Youth.

The sums appropriated shall be expended by the office of youth services of the department of human services for the purposes of this section.

SECTION 23. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 for the residential alternative community care program.

The sums appropriated shall be expended by the department of human services for the purposes of this section.

SECTION 24. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, to Volunteer Legal Services Hawaii for its Na Keiki Law Center project focusing on protecting the legal rights of children.

The sums appropriated shall be expended by the department of human services for the purposes of this section.

SECTION 25. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for the Domestic Violence Clearinghouse and Legal Hotline for Maui program services.

The sums appropriated shall be expended by the judiciary, circuit court of the second circuit, for the purposes of this section.

SECTION 26. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 for costs related to homeless assistance.

The sums appropriated shall be expended by the housing and community development corporation of Hawaii in accordance with chapter 103F, Hawaii Revised Statutes, for the purposes of this section.

SECTION 27. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 for the Program for All Inclusive Care for the Elderly to expand to the neighbor islands.

The sums appropriated shall be expended by the department of human services in accordance with chapter 103F, Hawaii Revised Statutes, for the purposes of this section.

SECTION 28. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a subsidy pursuant to chapter 42F, Hawaii Revised Statutes, to the St. Francis Medical Center for the operations of the bone marrow registry.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 29. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Maui Economic Opportunity, Inc., and its night transportation service for dialysis treatment programs in Maui county.

The sums appropriated shall be expended by the office of community services of the department of labor and industrial relations for the purposes of this section.

SECTION 30. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for the Hawaii Seropositivity and Medical Management Program.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 31. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Friends of Foster Kids to develop infrastructure to transition into a professional child welfare services agency.

The sums appropriated shall be expended by the department of human services for the purposes of this section.

SECTION 32. There is appropriated out of the emergency and budget reserve fund the sum of $        or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, to the Self-Help Housing Corporation of Hawaii for self-help housing technical services to assist low- and very low-income families to build and own their own homes.

The sums appropriated shall be expended by the housing and community development corporation of Hawaii for the purposes of this section.

SECTION 33. There is appropriated out of the emergency and budget reserve fund the sum of $ or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Parents and Children Together for programs on child development and parenting skills and other programs that foster positive environments between parents and their children.

The sums appropriated shall be expended by the department of human services for the purposes of this section.

SECTION 34. There is appropriated out of the emergency and budget reserve fund the sum of $ or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for the Boys and Girls Club of Hawaii in Papakolea to continue its youth services program.

The sums appropriated shall be expended by the office of youth services of the department of human services for the purposes of this section.

SECTION 35. There is appropriated out of the emergency and budget reserve fund the sum of $ or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for the Honolulu Community Action Program in Waianae to support the Hawaii Family Advocacy Program in assisting families in the child protective services system.

The sums appropriated shall be expended by the office of community services of the department of labor and industrial relations for the purposes of this section.

SECTION 36. There is appropriated out of the emergency and budget reserve fund the sum of $ or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Kokua Kalihi Valley Comprehensive Family Services, in collaboration with the Kalihi-Palama Health Center, to establish school-based or school-linked health services at the high school and middle schools in Kalihi.

The sums appropriated shall be expended by the department of health for the purposes of this section.

SECTION 37. There is appropriated out of the emergency and budget reserve fund the sum of $ or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for staff salaries including a full-time physician, a half-time psychologist, two full-time nurses, one substance and abuse counselor, and other support staff necessary for the operation of the West Hawaii community health center located in Kailua-Kona on the island of Hawaii.

The sums appropriated shall be expended by Hawaii health systems corporation of the department of health for the purposes of this section.

SECTION 38. There is appropriated out of the emergency and budget reserve fund the sum of $ or so much thereof as may be necessary for fiscal year 2005-2006 and the sum of $        or so much thereof as may be necessary for fiscal year 2006-2007 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, to hire and maintain a hospitalist inpatient staff of four full-time physicians at the Kona community hospital; provided that these funds shall be allocated to the Kona hospital foundation.

The sums appropriated shall be expended by the Hawaii health systems corporation of the department of health for the purposes of this section.

SECTION 39. This Act shall take effect on July 1, 2005.
