A BILL FOR AN ACT

 

relating to condominium property regimes.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 514A-83.5, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

"(a) The association's most current financial statement, and the minutes of the board of directors' meetings[,] for the current and prior year, once approved, shall be available to any owner at no cost or on [twenty-four hour] twenty-four-hour loan, at a convenient location designated by the board of directors[.]; provided that where an association maintains an office on the condominium property or employs a resident manager, the regular meeting minutes and agendas for the current and prior year shall be made available at that office or at the apartment of the resident manager."

SECTION 2. Section 2 of Act 164, Session Laws of Hawaii 2004, is amended by amending subsection (a) of section    -154 to read as follows:

"(a) The association's most current financial statement, and the minutes of the board's meetings[,] for the current and prior year, once approved, shall be provided to any interested unit owner at no cost or on [twenty-four hour] twenty-four-hour loan, at a convenient location designated by the board[.]; provided that where an association maintains an office on the condominium property or employs a resident manager, the regular meeting minutes and agendas for the current and prior year shall be made available at that office or at the apartment of the resident manager."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2099.
