WHEREAS, the Hawaii State Constitution guarantees that the Board of Regents of the University of Hawaii shall have the exclusive jurisdiction over the internal structure, management, and operation of the University of Hawaii, subject only to the exclusive jurisdiction of the Legislature to identify and enact laws of statewide concern; and

WHEREAS, the State Constitution also specifies that the Board of Regents shall appoint the President of the University to act as its executive officer; and

WHEREAS, in 2001, the University of Hawaii was reorganized such that the University of Hawaii system and the University of Hawaii at Manoa are no longer led by the same executive officer; and

WHEREAS, in 2001, the Board of Regents reorganized the organizational structure of the University with the understanding that establishing the Office of the Chancellor of the University of Hawaii at Manoa would incur no additional administrative costs to the University; and

WHEREAS, administrative costs to the University of Hawaii at Manoa have increased by over $2,700,000 since the establishment of that office, resulting in an infusion of funds to the University of Hawaii at Manoa, but almost none to the community colleges, thereby further exacerbating the inequities of the university system; and

WHEREAS, to further complicate matters, the Board of Regents recently approved a reorganization to the office of the Manoa Chancellor that will require an additional $3,100,000 to fund; and

WHEREAS, there has been over $5,800,000 in additional administrative costs at the University of Hawaii at Manoa since the establishment of the Office of the Manoa Chancellor; and

WHEREAS, the increased administrative costs will require additional revenues, raising the specter of either increased tuition and fees or increased legislative appropriations to fund those extra costs; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2005, that the Board of Regents of the University of Hawaii is respectfully requested to reintegrate the Office of the Chancellor of the University of Hawaii at Manoa with the Office of the President of the University of Hawaii system; and

BE IT FURTHER RESOLVED that the Board of Regents is specifically requested to appoint the President of the University of Hawaii system as the chief executive officer of both the University of Hawaii system and the University of Hawaii at Manoa; and

BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Chair of the Board of Regents and the President of the University of Hawaii.
