HOUSE CONCURRENT

RESOLUTION

 

Requesting the Hawaii community development authority to secure the services of the Department of land and natural resources boating and ocean recreation division to provide oversight of boating operations at kewalo basin.

 

 

WHEREAS, since 1976 when the Kakaako Community Development District and its boundaries were established, the Department of Transportation Harbors Division (DOT-HD), through informal agreement, was delegated the responsibility of managing the activities and fast lands abutting the entire length of Kewalo Basin; and

WHEREAS, as the managing entity, DOT-HD received substantial income from high revenue-producing activities including the John Dominis and Fisherman's Wharf restaurants, fish auction house, fish packing plant, a boat repair facility, a boat sales dealership, various aku boat fishing fleets, and tour-cruise boating operations; and

WHEREAS, through attrition and the relocation of businesses from continuing redevelopment in accordance with the master plan, the Hawaii Community Development Authority (HCDA) and DOT-HD have mutually agreed that the management of these lands and the activities thereon can and should be managed by another entity; and

WHEREAS, HCDA acknowledges that its prime responsibility is the appropriate development of lands under its jurisdiction toward the best use and benefit for the people of Hawaii and that the allocation of derived revenues, beyond HCDA's operating costs and debt service obligations, is a matter of legislative determination; and

WHEREAS, it is logical and appropriate that the Department of Land and Natural Resources Boating and Ocean Recreation Division (DLNR-BORD), with all its expertise and experience in administering the state's boating facilities and related activities on all islands, be employed to assist HCDA by overseeing the boating operations and associated ancillary services at Kewalo Basin; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2005, the Senate concurring, that HCDA is requested to secure the services of DLNR-BORD to oversee all boating and related ancillary activities and services at Kewalo Basin; and

BE IT FURTHER RESOLVED that HCDA advise the Speaker of the House of Representatives and the President of the Senate on any proposed selection regarding the managing entity of the boating operations at Kewalo Basin before implementing or announcing such action; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Executive Director of HCDA and Chairperson of the Board of Land and Natural Resources.
