RESOLUTION
URGING THE DEPARTMENT OF TRANSPORTATION TO EXPEDITiously conclude ITS NEGOTIATIONS WITH HAWAII SUPERFERRY, INC.
WHEREAS, Hawaii Superferry, Inc., plans to introduce interisland roll-on/roll-off passenger and freight ferry service within the Hawaiian islands in 2006; and
WHEREAS, the Department of Transportation (DOT) is in negotiations with Hawaii Superferry regarding fees to use DOT harbor facilities; and
WHEREAS, DOT is requesting $40,000,000 in funding for harbor improvements to accommodate the Hawaii Superferry; and
WHEREAS, the negotiations with Hawaii Superferry need to be completed and reported to the Legislature in a timely manner; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2005, the Senate concurring, that DOT is urged to expeditiously conclude its negotiations with Hawaii Superferry, Inc.; and
BE IT FURTHER RESOLVED that DOT immediately report to the Legislature on the conclusion of its negotiations and include in its report:
(1) The repayment schedule for any funding provided;
(2) An outline of the terms for the use of the harbor facilities; and
(3) The impact on existing use of the harbors;
and
BE IT FURTHER RESOLVED that if all parties are not satisfied as to the outcome of the negotiations, DOT is requested to withhold any funding for harbor improvements specifically intended for the accommodation of the Hawaii Superferry; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Transportation and to the Chief Executive Officer of Hawaii Superferry, Inc.
