RESOLUTION
Requesting the Legislative Reference Bureau to collect information on accident reports on the riding in the cargo beds of Pickup Trucks and current nationwide laws on the riding in the cargo beds of Pickup Trucks.
WHEREAS, each year, in the United States, approximately 200 persons die from pickup truck bed-related injuries, according to the National Center for Statistics and Analysis, National Highway Traffic Safety Administration; and
WHEREAS, traumatic brain injury (TBI) is the leading cause of death from falls and ejections from pickup truck beds according to the National Highway Traffic Safety Administration, and survivors of these incidents may suffer permanent disabilities; and
WHEREAS, pickup beds are not designed for human transportation, and lack seat belts and other safety features; and
WHEREAS, in 1996, the Hawaii legislature enacted a law to prohibit children under 13 years old from riding in pickup beds; and
WHEREAS, the law should be extended to cover all ages as State residents of rural areas and neighbor islands frequently utilize pickup beds to transport people at high risk of injuries and fatalities; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2005, the Senate concurring, that the legislature requests the Legislative Reference Bureau to perform collect information on:
1) County police department reports of each incident of accidents involving pickup trucks and the number of injuries and fatalities from riding in pickup cargo areas; and
2) Current laws and penalties in the United States dealing with riding inside of the beds of pickup trucks;
and
BE IT FURTHER RESOLVED that the state Department of Transportation and each county police department is requested to assist the Legislative Reference Bureau by providing it with all relevant research and data already compiled; and
BE IT FURTHER RESOLVED that the Legislative Reference Bureau report its findings and recommendations to the Legislature at least 20 days prior to the convening of the Regular Session of 2006; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Legislative Reference Bureau, the Director of the Department of Transportation and the chiefs of each county's police department.
