HOUSE CONCURRENT

RESOLUTION

 

REQUESTING THE DEPARTMENT OF LAND AND NATURAL RESOURCES TO AMEND title 13, chapter 34, HAWAII ADMINISTRATIVE RULES, THE PUPUKEA MARINE LIFE CONSERVATION DISTRICT, OAHU, TO ALLOW HOOK AND LINE POLE FISHING FOR AKULE.

 

 

WHEREAS, the akule or big-eyed shad is a transient fish that moves freely inshore during the day and moves offshore during the night; and

WHEREAS, the akule is regarded as a favorite food by many, and is a popular target fish for both recreational and commercial fishers; and

WHEREAS, the Pupukea Marine Life Conservation District (Conservation District) on Oahu was established in January 1983, through Hawaii Administrative Rules title 13, chapter 34, which was subsequently amended to improve regulations for the Conservation District; and

WHEREAS, the rules for the Conservation District on Oahu were amended to allow netting of akule in the Waimea Bay area of the Conservation District during certain months of the year; and

WHEREAS, the establishment of marine life conservation districts ensures the replenishment of the state's precious ocean resources; and through prudent and flexible management, a resource can be both sustainable and enjoyed for subsistence and recreational purposes in a way that will have no negative impact on the resource and, very importantly, help promote the establishment of future marine managed areas throughout the state; and

WHEREAS, the Department of Land and Natural Resources (DLNR) recognizes that the akule is a highly prolific fish with a lifespan of three years and is not in danger of being overfished; and

WHEREAS, DLNR is also cognizant of and is addressing the potential conflicts within the Conservation District between commercial users and those who enjoy hook and line fishing for akule; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2005, the Senate concurring, that DLNR is requested to amend its administrative rules, to allow hook and line pole fishing for akule within the Conservation District; and

BE IT FURTHER RESOLVED that DLNR is requested to consider different options regarding where and how hook and line pole fishing for akule within the Conservation District may be allowed; and

BE IT FURTHER RESOLVED that DLNR is requested to submit a report of any actions taken to amend its rules to the Legislature no later than 20 days prior to the convening of the Regular Session of 2006; and

BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources.
