RESOLUTION
requesting reports on the effectiveness of the hawaii insurance bureau's fire rating program.
WHEREAS, the Hawaii Insurance Bureau (Bureau) is a nonprofit corporation licensed by the Insurance Division of the Department of Commerce and Consumer Affairs to act as a rating organization for property and casualty insurance in this State; and
WHEREAS, for purposes of fire ratings, the Bureau reviews properties and areas and categorizes them into ten fire protection classes with a rating of ten being the most unprotected and a rating of one being the most protected; and
WHEREAS, after the Bureau conducts its fire protection review and classifies properties and areas, the Bureau disseminates the information to all property and casualty insurers for use in the establishment of rates for their policies; and
WHEREAS, although the Bureau is licensed by the State to establish statewide fire classifications, it appears that insurers are not required to use such classifications in establishing their rates; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2005, the Senate concurring, that the Insurance Commissioner, Hawaii Insurers Council, and the Bureau are requested to submit reports to the Legislature relating to the effectiveness of the Bureau's fire rating program no later than 20 days prior to the convening of the Regular Session of 2006; and
BE IT FURTHER RESOLVED that the reports include responses to the following:
(1) How soon after a change in the fire protection status does the Bureau revise its classification;
(2) Why are insurers not required to use the Bureau's fire classifications in establishing rates; and
(3) What impact has the Bureau's fire classification procedures had on homeowner's insurance;
and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Insurance Commissioner, President of the Bureau, and the Executive Director of the Hawaii Insurers Council.
