A BILL FOR AN ACT

 

relating to education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that, due to federal No Child Left Behind mandates and state expectations to have highly qualified personnel for all instructional positions, the requirement and recognition of academic qualifications and completion of a teacher education program are extremely important.

The purpose of this Act is to authorize the board of education to:

(1) Appoint an advisory salary commission to develop and recommend a substitute teacher classification and compensation plan; and

(2) Review, amend, and approve the substitute teacher classification and compensation plan.

This Act replaces the existing statutory practice of linking compensation levels to a classification or step of a full time teacher's bargaining unit salary schedule with a substitute teacher classification and compensation plan approved by the board of education.

SECTION 2. (a) The board of education shall appoint an advisory salary commission, to be convened no later than June 30, 2005, and every three years thereafter, to develop and review a substitute teacher classification and compensation plan.

(b) The commission shall be placed within the department of education for administrative purposes.

(c) The purpose of the advisory salary commission shall be to develop a substitute teacher classification and compensation plan for the board of education to review.

(d) The advisory salary commission shall be composed of five members to be appointed by the board of education. The advisory salary commission shall elect a chairperson from among its own members.

(e) The advisory salary commission shall have the following duties:

(1) Develop a classification and compensation plan for substitute teachers commensurate with a substitute teacher's educational training and academic qualification; and

(2) Consider, among other things, various factors such as full time teachers' salaries, substitute teacher pay in other states, and geographical hardships.

(f) The members of the advisory salary commission shall serve without compensation but shall be reimbursed for necessary travel expenses.

(g) A member of the advisory salary commission shall be immune from civil liability as provided in section 26-35.5, Hawaii Revised Statutes.

SECTION 3. The advisory salary commission may request assistance from the department of education or any school staff as may be necessary to facilitate its work.

SECTION 4. The advisory salary commission shall submit an interim report of its findings and recommendations to the board of education no later than September 1, 2005. A final report shall be submitted to the board of education no later than December 31, 2006.

SECTION 5. Section 302A-624, Hawaii Revised Statutes, is amended by amending subsection (e) to read as follows:

"(e) [Effective July 1, 1996, the per diem rate for substitute teachers shall be based on the annual entry step salary rate established for a Class II teacher on the most current teachers' salary schedule. The per diem rate shall be derived from the annual rate in accordance with the following formula:

Per Diem Rate = Annual Salary Rate ¸ 12 months ¸ 21

Average Working Days Per Month]

Effective July 1, 2005, the per diem rate or rates for substitute teachers shall be determined by the board of education based on a classification and compensation plan approved by the board."

SECTION 6. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 7. This Act shall take effect upon its approval.
