A BILL FOR AN ACT
RELATING TO FROZEN FOOD PRODUCTS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 328-61, Hawaii Revised Statutes, is amended to read as follows:
"§328-61 Notifying consumer. (a) No person shall sell or offer to sell any uncooked thawed food [which] that substantially resembles the physical appearances of the fresh food without a label, as hereinafter described, notifying the purchaser that [such] the food had been frozen and then thawed out; provided that this section shall not apply if the thawed foods are processed by grinding or have been dehydrated before being offered for retail sale.
(b) No person shall sell or offer to sell any baked goods that have been previously frozen and are being offered for sale in a thawed state, unless the person posts a sign or notice within close proximity of the point of display of the baked goods that notifies purchasers that it is a common practice to flash freeze baked goods to preserve freshness. The sign or notice shall:
(1) Be entitled, "Baked Goods Previously Frozen";
(2) Include the words, "Previously Frozen and Thawed" and be composed in all capital letters in bold print in a minimum fourteen-point font size, except as provided in paragraph (3); and
(3) List all baked good products that have been previously frozen, using all capital letters in bold print in a minimum ten-point font size; provided that all suppliers and distributors of previously frozen baked goods for resale in the state shall provide their respective retailers with a listing that contains the name of a product and the name of the product's manufacturer for all baked good products supplied or distributed that have been previously frozen and thawed.
No previously frozen baked good product shall use the term "fresh" as part of the label or advertising to describe the product unless the baked good has been maintained in an unfrozen state."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect on January 1, 2006.
