A BILL FOR AN ACT
RELATING TO THE PENAL CODE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 707, Hawaii Revised Statutes, is amended to read as follows:
"§707- Criminal impersonation. (1) A person commits the offense of criminal impersonation if the person, while impersonating another, knowingly uses a computer to solicit, persuade, coerce, entice, induce, procure, or lure a minor less than sixteen years old with intent to commit a sexual offense against the minor.
(2) Criminal impersonation does not merge with the sexual offense that is its object and does not require commission of the sexual offense.
(3) Criminal impersonation is a class B felony."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
