A BILL FOR AN ACT

 

relating to medicaid.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§346-    Medicaid waiver application; requirements. (a) The department may apply for waivers of applicable federal laws and regulations, following legislative approval, as necessary to implement more appropriate systems of health care for medicaid recipients and reduce the cost of the medicaid program to the state and federal governments. The department shall implement the programs within a reasonable period of time after federal approval. These programs shall be designed primarily to reduce the need for inpatient care, custodial care and other long-term or institutional care, and other high-cost services.

(b) Legislative approval of the application shall be obtained as follows:

(1) When the legislature is in session, by a concurrent resolution adopted by a majority vote of the senate and house of representatives; and

(2) During the legislative interim, by a majority vote of the members of a joint committee consisting of the chairs of two standing committees from the house of representatives appointed by the speaker and the chairs of two standing committees from the senate appointed by the senate president. The joint committee may conduct legislative hearings or informational briefings in its deliberations on the application."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect on July 1, 2999.
