A BILL FOR AN ACT

 

relating to the deposit beverage container program.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 342G, Hawaii Revised Statutes, is amended by adding a new section to part VIII to be appropriately designated and to read as follows:

"§342G- Exemption. Notwithstanding any other provision of this part, this part shall not apply to a deposit beverage container that is sold and delivered to a passenger vessel intended for use and consumption on the passenger vessel; provided that the entity operating the passenger vessel has a recycling plan prescribed or approved by the department of health."

SECTION 2. Section 342G-101, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

""Passenger vessel" means any domestic- or foreign-flagged marine vessel or air carrier used primarily for transporting persons to, from, or within the State."

SECTION 3. Section 342G-101, Hawaii Revised Statutes, is amended by amending the definition of "on-premises consumption" to read as follows:

""On-premises consumption" means to consume deposit beverages by a [consumer] patron immediately and within the area under control of the establishment, including bars, restaurants, passenger ships, and airplanes."

SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
