RELATING TO FEES.

Requires cruise ship passenger fees collected by DLNR/DOBOR to be "earmarked" and set aside for use only by the DLNR boating facilities that provided the cruise ship services.

RELATING TO WAIKANE VALLEY.

Authorizes the issuance of general obligation bonds for the purchase of Waikane Valley from the federal government pending the removal of existing ordnance.

RELATING TO PROCUREMENT.

Requires state agencies to purchase locally grown agricultural products under certain circumstances. Allows purchasing agencies to parcel purchases in situations where a local producer is unable to supply an entire order. Establishes a new category of "Hawaii product" to include food products entirely produced in Hawaii. Establishes a 15% price preference buffer for food products entirely produced in Hawaii.

Instituting a misdemeanor penalty and fines for any person obstructing access to the sea, the shoreline, any inland recreational area, or any of the public rights-of-way, transit areas, or public transit corridors.

RELATING TO LAND USE COMMISSION.

Limits land use commission jurisdiction over district boundary amendments to those involving land areas greater than 50 acres except in the conservation district. Gives counties sole authority over district boundary amendments involving land areas less than 50 acres, except in conservation districts.

RELATING TO THE LAND USE COMMISSION.

Permits the counties to reclassify lands from the agricultural district to the rural district for areas not exceeding 100 acres, subject to disapproval by the legislature.

Sets forth standards and criteria for the identification of important agricultural lands. Allows the counties to study, determine, and recommend to the Land Use Commission lands which should be designated as important agricultural lands. RELATING TO AGRICULTURE.

Sets forth policies and procedures for identifying and managing important agricultural lands (IAL); directs the creation of a task force to develop incentives for IAL; allows agricultural tourism, holiday, and agriculture-related special events on agricultural district lands.

Allows Governor select one appointment and select two appointments each from lists of nominees submitted by the speaker of the house of representatives, the president of the senate, the minority leader of the house of representatives, and the minority leader of the senate.

Revises provisions that impair the transfer of agricultural land from the Department of Land and Natural Resources to the Department of Agriculture.

RELATING TO AGRICULTURE.

Requires the department of land and natural resources to enter into land exchange negotiations with the private landowners of land in the Waialua to obtain title to agricultural lands in the area. Transfers control and title to obtained lands to the agribusiness development corporation. Establishes regional agricultural subcommittee for the area to advise corporation on management of the lands.

RELATING TO STATE AND COUNTY TORT LIABILITY.

Repeals sunset date for public land liability immunity established by Act 190, SLH 1999, and sunset date for state and county tort liability relating to lifeguard services established by Act 170, SLH 2002.

RELATING TO FLOODS.

Requires DLNR to research the development of a sustainable flood project sponsorship prior to Helemano-Paukauila-Kaukonahua watershed management project.
