Extends additional social security benefits to employees of the State or any political subdivision.

Establishes a uniform definition of "employment" for the DLIR for benefit eligibility purpose.

RELATING TO OFFENSES AGAINST PUBLIC ADMINISTRATION.

Creates 2 new offenses related to illegal compensation of public servants: (1) bribery in the second degree; and (2) unlawful gifts to public servants by persons subject to their jurisdiction.

RELATING TO PROCUREMENT.

Requires a bidder for construction work to file a sworn statement specifying that the construction work, if performed by a subcontractor, will be performed by employees who are paid the prevailing rate of compensation, including benefits, and working under the terms and conditions of employment as persons employed by the bidder.

RELATING TO LABOR.

Ensures that employees who are unemployed temporarily due to a labor dispute shall not be disqualified from receiving unemployment benefits if the parties to the labor dispute have reached an impasse and, prior to a work stoppage, the striking workers offer to submit the dispute to a fact-finding process.

RELATING TO UNEMPLOYMENT BENEFITS.

Establishes a rebuttable presumption that a claimant's unemployment during a labor dispute is not due to an actual, substantial curtailment of work at the employer's establishment, and thus the claimant is entitled to unemployment compensation; requires clear and convincing evidence to overcome the presumption.

RELATING TO EMPLOYEE ORGANIZATIONS.

Requires all parent labor unions based in the mainland to return at least 50% of all union fees collected from their local affiliates, branches, or subsidiaries in Hawaii in any appropriate form agreed upon, whether it is in cash, vacation leave, sick leave, or strike benefits.

RELATING TO EMPLOYMENT CONTRACTS FOR BROADCAST INDUSTRY EMPLOYEES.

Makes it unlawful for a broadcast employer to include in any employment contract with a current or prospective broadcast employee a provision that is a prospective employment access restriction.

Authorizes the use of Temporary Disability Insurance benefits for family leave purposes.

RELATING TO LABOR.

Conforms state statutory provisions to the Temporary Extended Unemployment Compensation Act of 2002. Eliminates the fund restriction to UI administrative purposes only, so that monies can also be used for other purposes. Directs the Department of Labor and Industrial Relations to utilize $1,473,900 in federal Reed Act funds for unemployment compensation (LBR171) and to utilize $1,473,900 in other federal funds to supplant general fund appropriations in the same amount for general administration (LBR902) for fiscal year 2003-2004 (HB1792 HD1)

RELATING TO COLLECTIVE BARGAINING IN PUBLIC EMPLOYMENT.

Creates a collective bargaining unit for substitute teachers of the DOE, including part-time employees working less than one-half of a full-time equivalent.
