RELATING TO MORTGAGE BROKERS AND SOLICITORS.

Requires mortgage brokers and solicitors to pass a licensing exam. Regulates advertising. Requires continuing education for license renewal. Expands definition of "mortgage broker". Requires written notice of borrower's rights. Creates right of action to recover on surety bond. (SD1)

RELATING TO PUBLIC BENEFIT CORPORATIONS.

Adopts Revised Model Nonprofit Corporation Act provisions relating to oversight of charitable and educational nonprofits by the attorney general. (SD1)

RELATING TO ACCESS TO VITAL STATISTICS RECORDS BY CHILD SUPPORT ENFORCEMENT AGENCIES.

Allows state and federal agencies conducting activities under the federal Title IV-D child support enforcement program to have direct access to vital statistics records maintained by the Department of Health, Office of Health Status Monitoring. (SD1)

RELATING TO VICTIM RESTITUTION.

Removes judicial discretion to mandate that defendants make restitution to victims. Provides that a defendant's financial ability to make restitution payments may be considered only in connection with establishing a restitution payment schedule. (HB2320 HD1)

RELATING TO ADMINISTRATIVE APPEALS.

Clarifies that administrative appeals for the Department of Human Services be decided in a fair and impartial manner. (SD1)

RELATING TO FAMILY COURT.

Eliminates closed hearings in Family Court Child Protective Services (CPS) matters. Allows parents involved in CPS matters to bring a non-lawyer advocate to hearings. Requires the Supreme Court to review Family Court judges. Requires Family Court judges to enforce perjury statutes. (HB1980 HD1)

Testimony may also be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies needed for submittal.
