RELATING TO THE DEPARTMENT OF THE ATTORNEY GENERAL. Allows the AG to retain and deposit into the Litigation Deposits Trust Fund 33% of any recovery from any civil action or settlement of a civil claim. |

RELATING TO TOBACCO. Prohibits the distribution of untaxed cigarette via telephone, mail order, the Internet, or other on-line sources. Revises provisions relating to the AG's seizure and confiscation authority. Addresses the availability of low-priced cigarettes to underage smokers concern. |

RELATING TO TOBACCO. Requires businesses engaged in the sale of cigarettes and other tobacco products at the retail level to acquire a retail tobacco permit from DOTAX. Provides criminal penalties for the retail sale of cigarettes or other tobacco products without a valid retail tobacco permit, and the seizure and forfeiture of cigarettes and other tobacco products sold, possessed, kept, acquired, distributed, or transported without a valid retail tobacco permit. |

RELATING TO FORFEITURES. Requires moneys from the criminal forfeiture revolving fund to be used for drug treatment programs. |

RELATING TO HABITUAL OPERATION OF A VEHICLE UNDER THE INFLUENCE OF AN INTOXICANT. Requires habitual DUI offender to pay driver education assessment, to be assessed for substance abuse or dependence, and to obtain treatment if necessary. Prohibits issuance of new license to habitual DUI offender until period of license revocation expires. Permits court to order offender to reimburse cost of blood or urine testing. Adds conforming references to habitual DUI offenders to use of intoxicants law. |

RELATING TO DRUG DEMAND REDUCTION ASSESSMENTS. Adds to the offenses for which an offender must pay the drug demand reduction assessment used to fund drug treatment. Amends priority of payment to require payment of restitution, probation fees, and crime victim compensation fees before assessment. Places burden on offender to show inability to pay. |

RELATING TO SPEEDING. Makes excessive speeding a petty misdemeanor and establishes penalties including driver's license suspension or revocation, driver retraining, fines, assessments, community service, and imprisonment. |

Persons wishing to testify should submit 30 copies of their testimony to the committee clerk, Room 227, State Capitol, 24 hours prior to the hearing. Testimony may also be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies needed for submittal.
The presentation of individual oral testimony may be limited at the Chair's discretion. Due to Session, the hearing must conclude by 11:00 a.m.
