RELATING TO TOXIC MOLD.

Authorizes DOH to establish permissible mold exposure limits and other standards for indoor environments. Establishes toxic mold advisory board. Establishes requirements for disclosure of mold and related conditions in commercial and residential real property and public buildings.

RELATING TO MENTAL HEALTH.

Clarifies that private pay patients are eligible to receive continuing day services from the DOH's adult mental health division on a voluntary basis if they pay in full the graduated charges established and imposed by the director of health. Appropriates $      in FY 2004-2005.

RELATING TO MENTAL HEALTH.

Requires annual statewide planning based on planning within each county and requires the appointment of a service area administrator in each county. Requires the service area board for each county to advise a county Service Area Administrator rather than a Community Mental Health Center chief.

RELATING TO QUALIFIED MENTAL HEALTH CENTER INVESTMENT TAX CREDIT.

Provides income tax credit for investments in qualified mental health centers using new treatment modalities in decreasing percentages beginning in the year the investment is made and for the following four years. Requires certification from director of health. Applies to tax years beginning after 12/31/2003.

RELATING TO INVOLUNTARY PSYCHIATRIC TREATMENT.

Authorizes DOH to adopt administrative rules to establish an administrative process allowing involuntary medication of psychiatric patients institutionalized at the Hawaii state hospital in order to alleviate mental illness and restore competency while protecting the rights of patients.

Abolishes the Hawaii Advisory Commission on Drug Abuse And Controlled Substances.

RELATING TO MENTAL HEALTH PRESCRIPTION DRUGS.

Prohibits restrictions upon a physician's ability to prescribe FDA-approved mental health medications under the Hawaii Rx and medicaid prescription drug expansion programs.

RELATING TO SUBSTANCE ABUSE.

Appropriates funds to the department of health to fund evidence-based substance abuse prevention programs.

RELATING TO MENTAL HEALTH AND ALCOHOL AND DRUG ABUSE INSURANCE.

Prohibits any rate, term, or condition that places a greater financial burden on an insured for access to treatment for mental illness than for access to treatment for a physical health condition. Requires insurance commissioner to report on effects of prohibition by 1/15/2005.

Includes major depression, which involves recurring episodes, in definition of "mental illness" and "serious mental illness." Includes major depression, which may be accompanied by incidence of alcohol or drug dependence, for mental illness coverage.

RELATING TO ALCOHOL AND DRUG DEPENDENCE BENEFITS.

Prohibits insurance policies from limiting treatment episodes for drug and alcohol dependence unless treatment is determined to be not medically necessary. Prohibits limitation of lifetime treatment episodes if treatment is determined to be medically necessary.

RELATING TO ALCOHOL AND DRUG ABUSE TREATMENT INSURANCE BENEFITS.

Creates parity for treatment of alcohol and drug dependence by repealing the limitation of two treatment episodes per lifetime with regard to coverage of alcohol and drug dependence benefits.

Provides for parity of insurance payments for drug and alcohol dependence treatment benefits as for treatment of physical conditions.
