RELATING TO CRITICAL ACCESS HOSPITALS.

Makes permanent definition of "critical access hospital", payment methodology to these hospitals using medicare reasonable cost principles, and exemption of these hospitals from medicaid reimbursement equity. (SD1)

RELATING TO STATE FUNDS.

Appropriates funds from the emergency budget and reserve fund for various health and human services programs, including grants, subsidies, and purchases of services, for FY 2004-2005. (SB3068 SD2)

RELATING TO MEDICAL RECORDS.

Amends the confidentiality provisions of the mental health, mental illness, drug addiction, and alcoholism law by changing "insurer" to "provider" to indicate that the provider may inform the patient of a reimbursement claim.

RELATING TO INVOLUNTARY PSYCHIATRIC TREATMENT.

Authorizes DOH to adopt administrative rules to establish an administrative process allowing involuntary medication of psychiatric patients institutionalized at the Hawaii state-operated or funded psychiatric facility in order to alleviate mental illness and restore competency while protecting the rights of patients. Requires report after three years. Effective 7/1/2010. (SD2)

RELATING TO PEER REVIEW.

Provides protections for physicians, hospitals, and other health care providers relating to review of medical errors. Defines "health care review organization." (SD1)

Provides for renewable special purpose licensing of persons working at federally qualified health centers or Native Hawaiian Health System sites. (SD2)

RELATING TO THE DENTAL EXAMINATION.

Authorizes acceptance of dental, dental hygienist, and restorative technique examination results from regional or state testing agencies if state constructed exams cannot be administered. (SD2)

RELATING TO NURSES.

Clarifies licensure, renewal, and reporting requirements. Repeals obsolete provisions. Requires Board of Nursing to report on findings regarding CGFNS and English proficiency examinations and their effect on nurse shortage and licensure. (SD2)

RELATING TO NURSES.

Establishes a joint formulary advisory committee to advise the board of nursing on issues relating to the formulary composed of three persons licensed as advanced practice registered nurses with prescriptive authority under chapter 457, three persons licensed as physicians under chapter 453, and three persons licensed as pharmacists under chapter 461. RELATING TO HEALTH INSURANCE.

Expands from 45 days to 60 days the time period within which, a managed care plan, after receiving an enrollee complaint, must send notification to the enrollee of its decision. (SD1)

RELATING TO GENERIC SUBSTITUTION OF PRESCRIPTION DRUG PRODUCTS.

Makes USFDA approved, therapeutically equivalent generic drug products substitutable upon approval by the Director of Health. (SD1)

RELATING TO VOLUNTARY ADMISSION FOR NONEMERGENCY TREATMENT.

Allows parents or guardians to admit individuals under the age of eighteen to nonemergency treatment facilities without the consent or countersignature of the individual. (SD2)

RELATING TO EMERGENCY MEDICAL SERVICES.

Deletes terminal condition as the sole circumstance when "comfort care only-do not resuscitate" protocols may be initiated by in-the-field emergency response personnel to persons whose heart or breathing has stopped. Allows a person, a person's guardian, agent, or surrogate with legal authority to make health-care decisions on behalf of the person to allow the withholding of cardiac resuscitation and artificial breathing or to revoke CCO DNR documents.
