Changes the ethanol investment tax credit to the ethanol facility tax credit (EFTC); bars other credits if EFTC is claimed; clarifies definitions; limits EFTC to investment amount; and allows EFTC only in years that the facility is operating at 75% of nameplate capacity or more and if production commences on or before 1/1/12. Amends the proposed maximum pre-tax wholesale price of regular unleaded gasoline by determining the baseline price according to the national spot price, as reported by the Oil Price Information Service; repeals the maximum pre-tax retail gasoline price; and establishes maximum pre-tax wholesale prices for mid-grade and premium gasoline and diesel fuel.
