RELATING TO STATE GOVERNMENT.

Repeals the compliance resolution fund and redirects fees to the general fund. Requires DCCA to return or discount fees if the fees collected in the prior year is a 110 per cent of the fees collected in the prior year and if the fees drop below 90 per cent, the fees shall be increased to eliminate the shortfalls. RELATING TO WIRELESS ENHANCED 911 SERVICE.

Establishes a monthly surcharge on mobile phone connections to fund implementation of wireless enhanced 911 by wireless providers and county public safety agencies; creates wireless enhanced 911 board to oversee collection and distribution of surcharge funds; requires reports to the legislature, protection of proprietary provider information, and regular audits of the fund. RELATING TO HOUSING FINANCING PROGRAMS.

Authorizes up to $2,000,000,000 in bonds to be issued by the Housing and Community Development Corporation of Hawaii (HCDCH) in connection with any program to provide housing for active or retired United States military personnel, their families, and other authorized persons. (HB2181 HD2)

RELATING TO BUSINESS REGULATION.

Expands the definition of gift certificate to reflect changes in retail industry technology; extends the minimum life of certificates to seven years; provides that consumers may obtain cash after utilizing 90 percent of the value of the certificate; prohibits service charges or dormancy fees; no longer requires issuers to report unclaimed amounts under the Unclaimed Property Act. RELATING TO ARBITRATION.

Provides that a policyholder, beneficiary, or designee shall be awarded reasonable attorney's fees and costs of arbitration in an arbitrated insurance dispute when an arbitrator or arbitration panel orders an insurer to pay benefits to the policyholder. (HB2786 HD1)

RELATING TO MORTGAGE BROKERS AND SOLICITORS.

Requires mortgage brokers and solicitors to pass examinations and fulfil continuing education requirements for licensure; regulates advertising by mortgage brokers; requires mortgage brokers to provide borrowers with written summary of rights; strengthens enforcement mechanisms and increases penalties; raises licensure bond to $50,000 and imposes fines and license forfeiture for failure to maintain bond; adds two new grounds for suspension or revocation of license; permits DCCA to adopt rules requiring disclosure of investment and marketing strategies. RELATING TO INSURANCE FRAUD.

Amends the Insurance Code to provide immunity from civil liability for persons who provide information to prevent, investigate, or prosecute insurance fraud, unless acting with malice or committing perjury. (HB1727 HD1)

Persons wishing to testify on TMG/CPH bills should submit 35 copies of their testimony to Room 230, for CPH/SAT and CPH/TMG bills submit 30 copies of their testimony and for CPH only bills, submit 25 copies of their testimony to the committee clerk, Room 219, State Capitol, 24 hours prior to the hearing. Testimony may also be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies needed for submittal.
