RELATING TO THE LANDLORD TENANT CODE.

Amends definition of "tenant" to include guests. Prohibits tenants from possessing, manufacturing, selling, or distributing dangerous or harmful drugs or drug paraphernalia. Authorizes landlord to rely upon notice or reports issued by law enforcement in termination proceedings.

RELATING TO CONSTRUCTION.

Requires a notice of claim process prior to any action against a construction professional and limit damages for any action claiming damages, indemnity, or contribution in connection with construction defects.

Requires claimant of construction defect to notify contractor and give contractor opportunity to repair the construction defect prior to litigation or arbitration.

RELATING TO CONSTRUCTION CLAIMS.

Allows contractors the opportunity to repair construction defects prior to litigation; outlines process to be followed before litigation is filed.

RELATING TO INSURANCE FRAUD.

Amends the insurance investigations and examinations law to provide immunity from civil liability for persons who provide information to prevent, investigate, or prosecute insurance fraud, except if acting with malice or committing perjury.

RELATING TO MORTGAGE BROKERS AND SOLICITORS.

Requires mortgage brokers to provide borrowers with a written summary of the borrower's rights and obligations not longer than one page in length and in 12-point font on consumer caution and home ownership counseling. Prohibits a continued course of misrepresentation that targets a particular type of borrower. Authorizes the department of commerce and consumer affairs to adopt rules regarding disclosures of a mortgage broker's marketing, commercial, and investment strategies. Increases penalties for violations of the laws. Raises the licensure bond from $15,000 to $50,000. Gives the commissioner adjudicatory powers.
