A BILL FOR AN ACT

 

relating to education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that it appropriated moneys for the expansion of the Makawao public library in 2002 through Act 177, Session Laws of Hawaii 2002. That appropriation included moneys for the planning, design, land acquisition and construction of the expansion. The legislature also finds that due to unforeseen circumstances such as drawn out negotiations for land acquisition, the project has been delayed and that the appropriated funds are set to lapse. The purpose of this Act is to reauthorize the appropriation of funds necessary for the expansion of Makawao public library.

SECTION 2. The director of finance is authorized to issue general obligation bonds in the sum of $5,180,000, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2004-2005 for the purpose of financing the construction costs of expanding Makawao library.

1. Planning 190,000

2. Design 265,000

3. Land Acquisition 225,000

4. Construction 4,500,000

SECTION 3. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2006, shall lapse as of that date.

SECTION 4. The sum appropriated shall be expended by the department of education for the purposes of this Act.

SECTION 5. This Act shall take effect on July 1, 2004.
