RELATING TO COLLECTIVE BARGAINING IN PUBLIC EMPLOYMENT.

Creates a collective bargaining unit for substitute teachers of the DOE, including part-time employees working less than one-half of a full-time equivalent. Allows the members of bargaining unit (14) to strike. Prohibits bargaining over wages as long as the wages of these employees are established in law.

RELATING TO LEAVES OF ABSENCE.

Implements an Internal Revenue Service approved special pay plan for all eligible employees of the State and county which will not enhance or diminish existing special pay benefits.

RELATING TO PREPAID HEALTH CARE PLAN.

Mandates that the prepaid health care advisory council not include a member from the insurance industry; provides for appointment of a chairperson with a limit of two four-year terms.

RELATING TO EXAMINATIONS FOR THE DETERMINATION OF PERMANENT IMPAIRMENT.

Requires employer-requested medical examinations for workers' compensation cases involving the determination of permanent impairment to be performed by a physician selected by mutual agreement of the parties, or if no agreement, by a physician appointed by the director of the department of labor and industrial relations.

RELATING TO EMPLOYMENT.

Requires successor employers of a covered establishment to retain at least fifty per cent of incumbent, nonsupervisory employees.

DECISION MAKING TO FOLLOW, IF TIME PERMITS.

Persons wishing to testify should submit 35 (3-hole punched) copies of their testimony to the committee clerk, Room 202, State Capitol during regular business hours, or outside the Senate Sergeant-at-Arms Office, Room 015, State Capitol for all other times, 24 hours prior to the hearing. Testimony may also be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies needed for submittal.
