RELATING TO FAMILY LEAVE.

Requires an employer who provides sick leave for employees to use up to ten days of the employee's accrued and available sick leave for family leave purposes in a single calendar year, except when the use of sick leave for family leave purposes is subject to a valid collective bargaining agreement. Defines "sick leave" under the Family Leave Law (Chapter 398, Hawaii Revised Statutes).

Conforms state statutory provisions to the Temporary Extended Unemployment Compensation Act of 2002. Eliminates the fund restriction to UI administrative use only, so that monies can also be used to pay for UI benefits as well as the administration of its system of public employment offices.

RELATING TO NEW ECONOMY WORKFORCE DEVELOPMENT.

Allows moneys in the employment and training fund to be used for employers to train their own employees, incentives for employers to train residents in skills in critically short supply, and incentives for employers to train workers recently unemployed or likely to be unemployed.

RELATING TO COLLECTIVE BARGAINING.

Authorizes the Legislature and the city councils to reject individual cost items agreed to during collective bargaining negotiations.

RELATING TO COLLECTIVE BARGAINING IN PUBLIC EMPLOYMENT.

Creates a collective bargaining unit for substitute teachers of the DOE, including part-time employees working less than one-half of a full-time equivalent. Allows the members of bargaining unit (14) to strike. Prohibits bargaining over wages as long as the wages of these employees are established in law.

Allows a faculty member or administrative, professional, or technical employee of UH with multiple part-time faculty appointments to meet eligibility requirements for membership in the ERS; allows faculty, lecturers, or administrative, professional, or technical staff employed at UH who hold multiple part-time appointments which together aggregate to at least one-half full-time equivalent position to become ERS members (HB317 HD1).

Requires spousal or reciprocal beneficiary consent to any retirement benefit option selected by a member. Designates option as the retirement benefit option when a spouse or reciprocal beneficiary refuses to consent to a member's election of a benefit option, but entitles the spouse or reciprocal beneficiary to an annuity of % of the allowance received by the member before death.

Minimizes the administrative processing of refunding contributions for the employees excluded from Social Security.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

Requires the ERS to pay interest on the retroactive amount due retirees whose pensions are not finalized within six calendar months following the month of retirement. Authorizes the ERS to assess the employing agency a late fee for each month of delay in reporting unused sick leave balances, lump sum vacation payments and other pertinent information (e.g., breakdown of retroactive payments) needed to finalize a retiree's pension.

Provides that a public employee who has been convicted of a felony that took place within the course and scope of the employee's duties must forfeit the employee's benefits starting from the date of the act constituting the felony of which the employee was convicted.
