RELATING TO THE JUDICIARY.

Provides the Judiciary budget for the 2003-2005 biennium.

RELATING TO PROFESSIONAL AND VOCATIONAL LICENSES.

Prohibits a governmental entity that administers student loans from certifying to a professional or vocational licensing board that a person is in default of a student loan unless the governmental entity obtains a judgment from a court that specifies the exact amount of the default.

RELATING TO TRAFFIC FINES.

Establishes a drug court program special fund where the funds are used for the various drug courts as directed by the chief justice of the supreme court. Directs $5,000,000 in fiscal years 2003-2004 and 2004-2005 of fines, forfeitures, assessments, and penalties for traffic infractions collected between July 1, 2003, and June 30, 2005, to the judiciary computer system special fund and deposits the excess fines, forfeitures, assessments, and penalties for traffic infractions collected between July 1, 2003, and June 30, 2005, grants, donations, and other funding sources into the drug court program special fund. Repeals the redirection of traffic infraction fines, forfeitures, assessments, and penalties provided in this measure on July 1, 2005.

RELATING TO THE COURTS.

Allows use of debit cards to pay for court costs except bail postings and driver's license and vehicle registration clearances, which must be paid in cash only.

RELATING TO TRAFFIC INFRACTIONS.

Repeals the requirement that an envelope directed to the traffic violations bureau of a district court for the purpose of answering a notice of traffic infraction include prepaid postage.

Removes law enforcement mileage fees from the costs covered by administrative hearing processing fees.

RELATING TO THE USE OF INTOXICANTS.

Establishes that the refusal of an individual, including persons under the age of twenty-one, legally arrested for driving while intoxicated to submit to a breath, blood, or urine test may be admissible in any criminal or civil proceeding.

Authorizes the expungement of a juvenile arrest record if the juvenile was counseled and released by the police once the juvenile has become an adult.

Repeals chapter 582; adopts model code interstate compact for juveniles.

RELATING TO ATTORNEY'S FEES FOR APPOINTED COUNSEL.

Increases compensation for court appointed counsel to rate used for federal District Court in Hawaii in 1990.

MAKING APPROPRIATIONS FOR CLAIMS AGAINST THE STATE, ITS OFFICERS, OR ITS EMPLOYEES.

Provides for the authorization and payment of claims against the State for refunds of taxes, for judgments and settlements, and for other miscellaneous payments.

RELATING TO THE ATTORNEY GENERAL.

Establishes a nuisance abatement unit within the department of the attorney general to provide for the enforcement and prosecution of violations of nuisance abatement laws in the penal code. Appropriates funds.

RELATING TO THE ATTORNEY GENERAL.

Requires the attorney general's office to represent an educational worker in any action brought against that educational worker for acts done in the performance of the educational worker's duty.

RELATING TO DRUGS.

Establishes the Drug Busters Program within the Department of the Attorney General to aggressively combat the sale and distribution of illegal drugs. Provides funding for drug prevention, enforcement, and treatment.

RELATING TO CHAPTER 846E, HAWAII REVISED STATUTES.

Clarifies that hearings related to the release of sex offender information are civil in nature and that the State is represented by the prosecuting attorney in these hearings. Repeals the process for reevaluating court orders granting public access to information regarding sex offenders. Specifies that the sex offender must give appropriate notifications whenever any of the sex offender's registration information changes.
