Authorizes the attorney general to seek civil penalties for abuse of a dependent elder; provides enhanced civil remedies for prevailing parties in cases involving abuse or neglect of a dependent elder. (SD1)

RELATING TO EMERGENCY CONTRACEPTIVES FOR SEX ASSAULT SURVIVORS IN EMERGENCY ROOMS.

Authorizes hospitals to provide emergency contraception to sexual assault survivors.

RELATING TO CHILD PROTECTIVE SERVICES.

Changes the number of days within which DHS is required to file a temporary foster custody petition from three to four working days, and to file reports with the court from fifteen to five days before the hearing date. Makes assault or terroristic threatening on a child welfare social worker a felony.

RELATING TO CHILD ABUSE.

Allows public safety officers, sheriffs, and deputy sheriffs to assume protective custody of child abuse victim; requires public safety officers, sheriffs, and deputy sheriffs to report child abuse cases.

RELATING TO CAREGIVER CONSENT.

Allows a caregiver to execute an affidavit of caregiver consent to enroll the minor in school and allow full participation in curricular and co-curricular activities; subjects caregivers to penalties under Part V, Chapter 710, HRS, for making a false statement on an affidavit for caregiver consent.

RELATING TO EMERGENCY MEDICAL SERVICES.

Deletes terminal condition as the sole circumstance when "comfort care only-do not resuscitate" protocols may be initiated by in-the-field emergency response personnel to persons whose heart or breathing has stopped. Allows a person, a person's guardian, or agent, or surrogate with legal authority to make health-care decisions on behalf of the person to allow the withholding of cardiac resuscitation and artificial breathing or to revoke CCO-DNR documents. RELATING TO PEER SUPPORT COUNSELING SESSIONS.

Provides for the confidentiality of any communication made by a participant or counselor in a peer support counseling session conducted by a law enforcement agency or by an emergency services provider.

DECISION MAKING TO FOLLOW, IF TIME PERMITS.

Persons wishing to testify should submit 25 copies (1 sided) of their testimony to the committee clerk, Room 227, State Capitol during regular business hours, or outside the Senate Sergeant-at-Arms Office, Room 015, State Capitol for all other times, 24 hours prior to the hearing. Testimony may also be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies needed for submittal. Oral testimony will be limited to three minutes.

If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign language interpreter, wheelchair accessibility, or parking designated for the disabled) please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.
