RELATING TO CRIMINAL PROPERTY DAMAGE.

Includes knowingly as a state of mind requirement for the offenses of criminal property damage in the first and second degrees.

RELATING TO EXPUNGEMENT.

Authorizes the additional criteria for expungement of juvenile arrest records of an adult who, as a minor, was counseled and released by police.

RELATING TO CRIMINAL PROCEDURE.

Sets forth a procedure for the prosecution of class C felonies via information. Allows for depositions of witnesses when prosecution is via information. Establishes a task force to study alternatives in criminal charging procedures.

RELATING TO HATE CRIMES.

Amends hate crime laws to apply to a defendant who intentionally selects a victim or property of a person because of hostility toward the person's actual or perceived gender identity or expression.

RELATING TO CRIMINAL OFFENSES.

Requires the Judicial Council to convene a task force to review criminal charging procedures to recommend legislative amendments. (CD1)

RELATING TO DISPOSITION OF CONVICTED DEFENDANTS.

Authorizes the courts to obtain jurisdiction over inmates in correctional facilities who qualify for alternative programs.

RELATING TO CHAPTER 711, HAWAII REVISED STATUTES.

Redefines the offense of disorderly conduct. Expands scope of violation of privacy to include recording or broadcasting a person's intimate area underneath clothing while in a public place, without that person's consent.

PROPOSING AMENDMENTS TO ARTICLE XVII OF THE HAWAII CONSTITUTION.

Proposes amendments to the Hawaii constitution regarding holding a constitutional convention and to provide that only yes or no votes be counted in determining whether or not a majority of votes have approved holding a constitutional convention.

DECISION MAKING TO FOLLOW, IF TIME PERMITS.

Persons wishing to testify should submit 30 copies (1 sided) of their testimony to the committee clerk, Room 227, State Capitol during regular business hours, or outside the Senate Sergeant-at-Arms Office, Room 015, State Capitol for all other times, 24 hours prior to the hearing. Testimony may also be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies needed for submittal. Oral testimony will be limited to three minutes.

If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign language interpreter, wheelchair accessibility, or parking designated for the disabled) please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.
