Proposes amendment to article V, section 6, of the State Constitution to provide that the Attorney General be elected as a nonpartisan rather than appointed by the Governor. |

RELATING TO DISPOSITION OF PROPERTY FORFEITED. Adds drug treatment education to the uses allowed from property and money distributed to state and county governments as a result of forfeiture to the State. |

RELATING TO BOARDS AND COMMISSIONS. Provides that members of state boards and commissions are liable to the State for damages resulting from gross negligence in authorizing or overseeing the expenditure of state or federal moneys that results in a substantial financial loss to the State. |

RELATING TO FORFEITURES. Amends the forfeiture statutes by adding provisions similar to the Civil Asset Forfeiture Reform Act of 2000 that allows removal of cases worth less than $3500 to small claims court and adds provisions for representation by counsel, adds provisions for burden of proof, adds an "innocent owner" defense, adds provisions for the release of seized property, and liability for wrongful seizure. Conforms the notice provisions to the requirements of the U.S. Constitution, and eliminates the requirement of a bond to claim seized goods. Authorizes moneys from the criminal forfeiture revolving fund to be used for drug treatment programs. |
