RELATING TO THE GENERAL EXCISE TAX.

Extends the current GET exemptions for: (1) Condominium common expenses paid by managers and (2) Hotel employee expenses paid by hotel operators, to include expenses paid by submanagers and suboperators and to include employee expenses in timeshare projects.

RELATING TO TAXATION.

Requires excise tax exemption on assessments by condominium associations and other homeowner associations to also apply to time share associations.

RELATING TO CONDOMINIUMS.

Extends the deadline for the Real Estate Commission's last progress report and final report on its review of the condominium property regimes law to 2003 and 2004, respectively. Appropriates $95,000 for FY2003-2004 to fund the temporary condominium specialist position and for related expenses.

Requires all condominium association managers to be certified. Sets forth certification process.

RELATING TO CONDOMINIUM PROPERTY REGIMES.

Exempts AOAOs from liability for purchase of, conveyance of, and allocation of expenses for the association's leased fee interest prior to 6/25/2002 if the AOAO had a good faith belief that the purchase or conveyance was valid.

RELATING TO HEALTH INSURANCE REIMBURSEMENTS.

Requires health insurance coverage for services and hearing aids under Chapter 451A, HRS, relating to hearing aid dealers and fitters.

SB 695

RELATING TO PROFESSIONAL COUNSELORS.

Establishes a professional counselors licensing program effective 7/1/05, subject to the accumulation of a minimum $43,000 in a startup trust fund by 10/1/04. Requires DCCA to report on the fund to the 2004 Legislature. Terminates the fund on 6/30/05 and mandates the fund balance to be deposited into the compliance resolution fund. Allows counselors with current national certification to be licensed upon application and payment of fees within one year of the licensing program's effective date. Authorizes the appointment of an administrative assistant and secretary. Repeals the program on 6/30/10.

RELATING TO ELECTRONIC MAIL.

Provides that the transmission of unsolicited commercial electronic mail is an unfair or deceptive act or practice. Establishes penalties.
