A BILL FOR AN ACT

 

relating to obstruction of ingress and egress.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to repeal the authorization to impose imprisonment upon a person who obstructs ingress or egress from a public or private place, in violation of section 852-1, Hawaii Revised Statutes.

SECTION 2. Section 852-2, Hawaii Revised Statutes, is amended to read as follows:

"§852-2 Penalty. Any person who refuses or wilfully fails to move as directed by such officer shall be fined not more than $200 [or imprisoned not more than six months, or both]." SECTION 3. Statutory material to be repealed is bracketed and stricken.

SECTION 4. This Act shall take effect upon its approval.
