REQUESTING THE REAL ESTATE COMMISSION TO REVIEW THE CONCEPT OF TERM LIMITS FOR CONDOMINIUM BOARD MEMBERS.
WHEREAS, condominiums play a significant role in housing in this State, as hundreds of thousands of Hawaii residents live in condominiums throughout the State; and
WHEREAS, condominium property regime laws, originally called horizontal property regime laws, were first enacted in 1961, and amended in piecemeal fashion after that, leading to a patchwork law that in some instances is unorganized, inconsistent, and obsolete; and
WHEREAS, in 2000, the Legislature realized that the condominium property regime laws, which affect so many people, needed to be recodified and directed the Real Estate Commission to do so; and
WHEREAS, this recodification process is not yet completed; and
WHEREAS, one area of condominium management that is often a source of friction is the unlimited terms of board members, and should be reviewed in conjunction with the proposed recodification; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-second Legislature of the State of Hawaii, Regular Session of 2003, that the Real Estate Commission is requested to review the issue of term limits for condominium board members; and
BE IT FURTHER RESOLVED that the Real Estate Commission submit a report on this issue to the Legislature no later than twenty days prior to the convening of the Regular Session of 2004; and
BE IT FURTHER RESOLVED that a certified copy of this Resolution be transmitted to the Chairperson of the Real Estate Commission.
