requesting the legislative reference bureau to conduct a study on the PROVISIONS OF THE MEDICAL MARIJUANA LAW.
WHEREAS, Act 228, Session Laws of Hawaii 2000, established the Medical Marijuana Law (Marijuana Law) legalizing the medical use of marijuana to certain individuals suffering from debilitating medical conditions; and
WHEREAS, the Marijuana Law limits the amount of marijuana a patient or caregiver may possess and provides other guidelines; and
WHEREAS, since the Marijuana Law has been in effect for a few years, some entities now believe that the Marijuana Law needs to be revised and clarified, and perhaps be more stringent; and
WHEREAS, many medicinal marijuana users and advocates oppose any changes in the Marijuana Law and feel more years of experience are needed; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-second Legislature of the State of Hawaii, Regular Session of 2003, that the Legislative Reference Bureau is requested to conduct a study to determine whether the Marijuana Law should be revised; and
BE IT FURTHER RESOLVED that the study should include but not be limited to:
(1) The number of medical marijuana users in the State;
(2) The types and frequency of problems that law enforcement entities experience because of the Marijuana Law;
(3) The feasibility of imposing a limit on the number of plants a person is allowed to possess or grow on a property;
(4) The types and frequency of problems occurring during the certification process, including who is allowed to grow the plant for the person certified; and
(5) Suggested legislation to improve the Medical Marijuana Law;
and
BE IT FURTHER RESOLVED that the Legislative Reference Bureau is requested to report on the study to the House of Representatives twenty days before the convening of the Regular Session of 2004; and
BE IT FURTHER RESOLVED that a certified copy of this Resolution be transmitted to the Director of the Legislative Reference Bureau.
