RELATING TO THE DEFINITION OF LANDOWNER FOR SAFE HARBOR AGREEMENTS AND HABITAT CONSERVATION PLANS.

Clarifies the definition of landowner eligible for coverage under safe harbor agreements and habitat conservation plans. Establishes consistent standards and processes for both public and private lands.

RELATING TO GUIDE DOGS, SIGNAL DOGS, AND SERVICE ANIMALS.

Imposes penal sanctions for intentionally interfering with the use of a guide dog, signal dog, or service animal; fraudulently misrepresenting oneself as the owner or trainer of such an animal; and causing injury or death to such an animal.

RELATING TO ANIMAL CRUELTY.

Requires veterinarians to report known or suspected cases of animal cruelty to a humane society or law enforcement. Provides for immunity from civil liability for reports made in good faith.

Removes the duty of collecting statistics and preparing an annual report from the family court director.

RELATING TO THE JURISDICTION OF THE COURTS.

Adds unlawful imprisonment in the second degree and interference with reporting an emergency or crime as violations over which family court has concurrent jurisdiction with district court.

Allows supreme court to determine whether to create, accept, retain case, fiscal, and administrative records in electronic form.

RELATING TO THE UNIFORM PROBATE CODE.

Decreases time in which to contest an informally probated will from the later of 12 months from the probate or 3 years from the death to 90 days after receiving notice of proceeding, 12 months from the date it was admitted to probate, or 30 days after an order approving the settlement, whichever is shorter.

Removes exception for venue where party can not be served.

RELATING TO ARRESTS.

Makes a knowing, rather than a willful, failure to appear in answer to a citation punishable by imprisonment of not more than 30 days or a fine or both. Increases the amount of fine from $100 to $1,000.

RELATING TO FORFEITURE OF BAIL OR BONDS.

Includes personal service as notice to principals that have forfeited bail or bond in criminal court.

RELATING TO VICTIMS OF CRIMES.

Adds a provision to the Hawaii Victim's Bill of Rights that would toll the statute of limitations for victims of crimes of violence, sex crimes, and certain other crimes, until the perpetrator of those crimes is released from the jurisdiction of the court (released from prison, parole, or probation).

RELATING TO FOREIGN PROTECTIVE ORDERS.

Provides for good faith immunity for law enforcement officers who enforce a foreign protective order that appears to be authentic.

RELATING TO IDENTITY.

Provides criminal penalties for those who steal the identity of another, and for those who obtain identity documents under false pretenses or use a false or fictitious identity.

RELATING TO COMPUTER CRIME.

Corrects a typographical error in one of the words that defines "access" in the context of computer crime.

DECISION MAKING TO FOLLOW, IF TIME PERMITS.

Persons wishing to testify should submit 45 copies, 3-hole punched of their testimony to the committee clerk, Room 202, State Capitol 24 hours prior to the hearing. Testimony may also be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies needed for submittal.

If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign language interpreter, wheelchair accessibility, or parking designated for the disabled) please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.
