RELATING TO THE HIGH TECHNOLOGY DEVELOPMENT CORPORATION.

Repeals part III of chapter 206M, HRS, reenacts the same provisions, and makes this Act retroactive to April 28, 2000, the day after the enactment of Act 72, SLH 2000. Clarifies that the governor's and legislature's approval are required before the issuance of any special facility revenue bonds. Appropriates funds for technology marketing and promotion, biotechnology development, and high technology capital improvements.

Requires the department to allocate these temporary positions according to pupil enrollment.

RELATING TO EDUCATION.

Streamlines application process for charter schools by establishing a charter school review panel and submittal process timeline. Provides for provisional approval of charters. Establishes the BOE as final appeals and approval authority. Provides that the per pupil allocation to any charter school shall not exceed the department’s average per pupil expenditure based upon a school of 320 students or less; establishes a preference in review for existing publicly funded schools or programs. Appropriates funds for charter schools.

RELATING TO TEACHER COMPENSATION.

Requires teachers to receive their normal annual increment or longevity increase, as the case may be, for a year's satisfactory service in any fiscal year that an increase in the appropriate salary schedule is effected, except as provided by law.

RELATING TO TOBACCO.

Establishes the cigarette tax stamp enforcement special fund, tobacco enforcement special fund, and cigarette tax stamp administrative special fund. Prohibits the resale of cigarettes purchased at sales outlets operated under the regulations of the Armed Services of the United States. Creates a presumption that all cigarettes are subject to the cigarette tax. Seeks appropriations from state general revenues to pay for the initial monitoring, administration, and enforcement of the cigarette tax stamp. Effective 1/1/2050

Assigns responsibility to market, operate, manage, and maintain the convention center facility to the Hawaii tourism authority (HTA); increases membership of the HTA board and clarifies that is a policy-making board; requires legislative notice for HTA contracts over $25,000; allocates TAT moneys to state parks special fund and caps the HTA at $60,000,000 annually; requires counties to spend 50% of any additional revenues on tourism activities; repeals HTA June 30, 2003; requires audit of the HTA with report to the 2002 Legislature.

Allows use of non-aerial common fireworks from 7:00 a.m. Chinese New Year's Eve to 7:00 p.m. Chinese New Year's Day. Allows use of non-aerial common fireworks only for cultural purposes. Requires permit to set off any non-aerial fireworks. Sets mandatory minimum penalty for certain violations.
