Establishes an earned time program providing incentives for inmate rehabilitation in which inmates may earn reductions in the minimum term of imprisonment set by the Hawaii Paroling Authority by making consistent progress in all of the following areas: work and vocational training, social adjustment, counseling and self-help, and therapeutic, educational, and literacy programs.

Establishes the Tobacco Enforcement Special Fund. Exempts the fund from central service surcharges and the reimbursement for departmental administrative expenses. Revises the distribution of the tobacco settlement moneys.

MAKING AN APPROPRIATION TO THE HONOLULU POLICE DEPARTMENT.

Appropriates funding to the city and county of Honolulu for the Honolulu police department to act as the state control terminal agency for the national crime information center and the national law enforcement telecommunications system.

RELATING TO SOLID WASTE MANAGEMENT.

Imposes beverage container requirements and fees. Requires beverage distributors to register with the State. Establishes the beverage container deposit special fund. Provides for the redemption of empty beverage containers. Provides requirements for recycling facilities and redemption centers.

RELATING TO PUBLIC DISPLAY.

Amends the inventory period for a licensee, who provides public displays of fireworks more than once a month, to import and store aerial common fireworks and special fireworks from six-months to twenty-four months. Charges a $100 license fee for public display companies, including public display companies that import and store fireworks. Repeals requirement that the fireworks permit for public display must be obtained not less than twenty days before the date of the display. Clarifies that the fee for permits for public display are in addition to any license fee and that the fee for a permit for public display shall be $110 per event and used for purposes specified in section 132D-11(a).

RELATING TO WATER POLLUTION.

Authorizes citizen lawsuits to enforce chapter 42D, Hawaii Revised Statutes, that covers water pollution.

RELATING TO GOVERNMENT.

Establishes an impact litigation unit in the Office of the Attorney General.

RELATING TO JUDGMENTS.

Allows for interest to be assessed on the total amount of the judgment except for pre-judgment interest against the State.

RELATING TO EDUCATION.

Reauthorizes and appropriates funds for the community-based youth leadership demonstration project for the Hilo-Hamakua-Kohala region of the Big Island, started in 1997 pursuant to section 78 of Act 328, Session Laws of Hawaii 1997.

RELATING TO EDUCATION.

Appropriates funds to the Department of Education to expand the E-academy concept to selected public high schools, and establish E-academies in selected public elementary, middle schools, and new century charter schools.

RELATING TO PUBLIC SCHOOLS.

Establishes the Hawaii school repair and maintenance trust fund as a separate fund of Hawaii 3R's, a nonprofit corporation, for coordination of private and federal efforts to repair and maintain public schools. Establishes a tax credit and procurement procedures for state contracts.

RELATING TO EDUCATION.

Requires the financial analysis of expenditures by the DOE to utilize analytical techniques that include examining trends, deviation from the norm or average, school-by-school comparison, and costs and benefits. Requires a financial analysis of expenditures with respect to "program" and "per pupil costs".

RELATING TO THE RENTAL HOUSING TRUST FUND.

Excludes pre-development loans made by the Housing and Community Development Corporation of Hawaii from the rental housing trust fund from loan-to-value ratio and debt-coverage ratio restrictions.

RELATING TO THE ISSUANCE OF SPECIAL PURPOSE REVENUE BONDS TO ASSIST NOT-FOR-PROFIT CORPORATIONS THAT PROVIDE HEALTH CARE FACILITIES.

Authorizes $142,000,000 in SPRB for the Kahala Senior Living Community.

RELATING TO THE ISSUANCE OF SPECIAL PURPOSE REVENUE BONDS TO ASSIST PALOLO CHINESE HOME.

Authorizes the issuance of special purpose revenue bonds to assist Palolo Chinese Home in financing the capital costs related to the expansion and construction of its facility.

Designates a portion of the Kapalama Military Reservation near Honolulu Harbor on the island of Oahu as both an industrial park site pursuant to 171-132 HRS and an eligible relocation site pursuant to 171-142 HRS.
