Changes the basis for calculating retirement allowances for elective officers from 3 1/2% to 2% per year. Applies on a prospective basis only.

RELATING TO SMOKING IN THE WORKPLACE

Requires employers with 2 or more employees to adopt a smoking policy. Prohibits smoking in enclosed areas of state-owned or state-controlled workplaces and all state-owned or state-leased vehicles; does not apply to dining areas of restaurants, bars, and hotel guest rooms. Does not regulate smoking in residential accommodation in building owned, leased or rented by the State.

RELATING TO THE HOISTING MACHINE OPERATORS ADVISORY BOARD

To statutorily place the hoisting machine operators advisory board within the department in accordance with article V, section 6 of the Hawaii constitution, and to authorize the hiring of an executive director for the Hoisting Machine Operators Advisory Board who shall be exempt from civil service. To Appropriate $50,000 out of the hoisting machine operators' certification revolving fund for fiscal year 2001-2002, and another $50,000 out of the fund for fiscal year 2002-2003, to carry out the purposes of the Act.

RELATING TO BOILER AND ELEVATOR SAFETY LAW

To provide for increased public safety and better customer service by: (1) allowing the department to set reinspection frequencies of elevators and kindred equipment based on safety considerations; (2) specifying that the department has the right to review construction and renovation plans of regulated equipment prior to issuing "permits to operate"; and (3) allowing special inspectors (boilers) and qualified inspectors (elevators) to issue renewal permits only.

RELATING TO WORKERS' COMPENSATION

Reduces the cost of workers' compensation benefits for businesses in Hawaii by providing alternatives to injured employees who are trying to restore their earning capacities and to set parameters for the utilization of rehabilitation services.

Makes the employment and training fund assessment permanent and sets the employment and training fund assessment rate at 0.03%.

Proposes and limits optional exemptions from the unemployment insurance law for business owners holding at least a 50% interest in their company.

RELATING TO SICK LEAVE

Requires an employer who provides sick leave to permit an employee to use their sick leave to attend to the illness of their child, parent, spouse, or reciprocal beneficiary. Prohibits an employer from denying the use of sick leave, discharging, demoting, suspending, or discriminating in the terms and conditions of employment against an employee for using or attempting to exercise the right to use sick leave to attend to the illness of a child, parent, spouse, or reciprocal beneficiary.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM

Allows qualified members of the Employees' Retirement System (ERS) to purchase their military service credit. Allows a surviving spouse of a member of the ERS to remarry and still receive retirement benefits arising for their former spouse's employment.

Requires bidders for printing and advertising services to file a sworn statement with the director or labor and industrial relations that the services to be performed will be performed under certain conditions. Establishes penalties for violating this requirement.
