RELATING TO BUSINESS REGISTRATION.

RELATING TO ADVANCE DIRECTIVES FOR PSYCHIATRIC CARE.

Clarifies health care directive laws; combines medical health care and mental health care directives under one health care decision law. (SD1)

RELATING TO TOBACCO.

Designates as illegal any package of cigarettes that bears a brand name that is a registered trademark of a participating manufacturer and the package was imported by anyone other than the participating manufacturer. Establishes a criminal offense for any person to affix any cigarette stamp to the package of any cigarettes that are illegal or altered. (HB518 HD1) (SAY (BR))

RELATING TO PRESCRIPTION DRUGS.

Extends the Good Samaritan Law to pharmacists, wholesale prescription drug distributor, pharmaceutical companies, or physicians who in good faith without remuneration provide pharmaceuticals and health care supplies to needy persons. (SD1) (SOUKI, Say)

RELATING TO SUBSTANCE ABUSE TESTING.

Deletes the requirement that individuals who are to be tested for substance abuse be given a "medication" disclosure form. (SAY (BR))

RELATING TO CONTROLLED SUBSTANCES.

Allows the administrator of the narcotics enforcement division to share information from the electronic prescription accountability system with a pharmacist employed by a pharmacy registered under section 329-32, HRS, who requests prescription information on a customer relating to a violation or possible violation of chapter 329, HRS. Also limits the authorization for the use of medical marijuana for certain professions. (SD1) (HAMAKAWA)

RELATING TO SEXUAL ASSAULT.

Deletes knowledge of the age of a minor for purposes of sexual penetration and sexual contact with a minor; criminalizes subjecting to sexual penetration and sexual contact a minor who is age 14, if the actor is 19 years of age or older and not married to the minor. (SD1)

RELATING TO PUBLICATION OF NOTICE.

Redefines "government agency" for purposes of the public notice requirement by not including the counties except for state procurement code and purchase of health and human services. The redefinition would allow counties to select their own rather than a state-selected publication in which to place a public notice. (HB382 HD1) (HAMAKAWA)

RELATING TO DRIVER LICENSING.

Requires all drivers under age eighteen to be accompanied by a licensed driver over age twenty-one when driving between 11:00 p.m. and 5:00 a.m. (SD1) (SOUKI)

RELATING TO CHILD PASSENGER SAFETY.

Requires drivers to place passengers less than 8 years and 80 pounds in a child passenger restraint system, except for booster seats in cars with lap seat belts, which for safety reasons are required only for children less than 8 years and 60 pounds. Children of 8 to 15 years must use seat belts. (HB135 HD2) (SOUKI)

RELATING TO SPEEDING.

Establishes fines for motorists who drive their motor vehicles at speeds greater than the maximum speed limit in school zone or construction areas. Sets maximum speed limit in school zones at 15 miles per hour. (SD1) (TAKAI, ARAKAKI, ITO, THIELEN, KAHIKINA, MEYER, LEONG, AHU ISA, ESPERO, MORITA)

RELATING TO COURTS.

Repeals the exemption from jury service for attorneys, heads of executive departments, judges, ministers or priests, and active members of the armed forces. A BILL FOR AN ACT RELATING TO USE OF INTOXICANTS.

Conforms amendments relating to revocation of motor vehicle registrations for repeat intoxicated drivers under ADLR proceedings with amendments that consolidate and conform offenses relating to operating a vehicle under the influence of an intoxicant. (SD1) (SAY)
