Allows the governor to contract for private sector operation of correctional facilities. Establishes criteria necessary for an acceptable contract for privatized operation of a correctional facility.

Repeals the 7/1/01 sunset date of Act 278, Session Laws of Hawaii 1999, to permanently eliminate the 30 percent cap on operating expenses of the Crime Victim Compensation Commission. Exempts the executive director and administrative assistant of the commission from the civil service law. Appropriates funds to compensate crime victims and their providers. Requires a report to legislature.

RELATING TO SENTENCING FOR DRUGS AND INTOXICATING COMPOUNDS OFFENSES.

Mandates substance abuse assessment/treatment for offenders under the custody of the Department of Public Safety. Implements a policy shift in addressing non-violent drug possession offenses by requiring mandatory community-supervision and treatment in lieu of incarceration. Repeals mandatory minimum sentence for Class C possession of methamphetamine.
