Your Committee on Transportation, Military Affairs and Government Operations, to which was referred S.C.R. No. 3 entitled:

"SENATE CONCURRENT RESOLUTION SUBMITTING TO THE LEGISLATURE OF THE STATE OF HAWAII FOR REVIEW OF ACTION TAKEN BY THE BOARD OF LAND AND NATURAL RESOURCES ON LAND EXCHANGES,"

begs leave to report as follows:

The purpose of this measure is to review a land exchange in South Hilo between the State of Hawaii and Mauna Kea Agribusiness Co., Inc.

Your Committee received testimony in support of this measure from the Board of Land and Natural Resources.

Your Committee finds that Section 171-50, Hawaii Revised Statutes, requires the Department of Land and Natural Resources to submit to the Legislature for introduction a resolution for legislative review of any land exchange. Section 171-50, Hawaii Revised Statutes, also subjects such actions to legislative disapproval by a two-thirds vote of either house, or by a majority vote of both houses.

Your Committee finds that the land exchange executed between the State of Hawaii and Mauna Kea Agribusiness Co., Inc., was necessary to provide sufficient parking at Haaheo Elementary School.

Upon careful review of the land exchange that is the subject of this measure, your Committee finds no cause for disapproval.

As affirmed by the record of votes of the members of your Committee on Transportation, Military Affairs and Government Operations that is attached to this report, your Committee concurs with the intent and purpose of S.C.R. No. 3 and recommends that it be referred to the Committee on Economic Development and Technology.
