Sir:

Your Committee on Judiciary, to which was referred S.B. No. 99 entitled:

"A BILL FOR AN ACT RELATING TO THE LIQUOR COMMISSION,"

begs leave to report as follows:

The purpose of this measure is to allow liquor commission employees to participate in election activities.

Your Committee received testimony in support of this measure from the Hawaii Government Employees Association.

Under existing law, liquor commission employees are prohibited from participating in campaign related activities, including running for public office. Your Committee believes that this is probably unconstitutional as a violation of civil rights, free speech rights, and voting rights. This measure would restore the deprivation of those rights.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 99 and recommends that it pass Third Reading.
