STAND. COM. REP. NO.411

Honolulu, Hawaii

, 2001

RE: S.B. No. 990

Honorable Robert Bunda

President of the Senate

Twenty-First State Legislature

Regular Session of 2001

State of Hawaii

Sir:

Your Committee on Transportation, Military Affairs and Government Operations, to which was referred S.B. No. 990 entitled:

"A BILL FOR AN ACT RELATING TO DEPUTY ATTORNEYS GENERAL,"

begs leave to report as follows:

The purpose of this measure is to clarify the duties of deputy attorneys general.

Your Committee received testimony in support of this measure from the Attorney General (AG).

This measure clarifies current law by requiring deputy attorneys general to perform their duties regardless of the source of funding for their compensation. Testimony of the AG indicated that the deputies occupying positions that are funded by resources other than state funds are often expected to service only the clients who pay their salaries. As a result, they may end up with less work than deputies paid by state funds. This measure allows the AG to assign deputies to work where the work is needed, regardless of the source of funding for their salary.

As affirmed by the record of votes of the members of your Committee on Transportation, Military Affairs and Government Operations that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 990 and recommends that it pass Second Reading and be referred to the Committee on Judiciary.

Respectfully submitted on behalf of the members of the Committee on Transportation, Military Affairs and Government Operations,
