Your Committees on Transportation, Military Affairs and Government Operations and Tourism and Intergovernmental Affairs, to which was referred S.B. No. 914 entitled:
"A BILL FOR AN ACT RELATING TO CONTRACTORS,"
beg leave to report as follows:
The purpose of this measure is to transfer responsibility for enforcing the law regarding issuance of building permits and registration of owner-builders, from the Regulated Industries Complaint Office to the counties. Additional fines are established which may be imposed on the counties.
Your Committees received testimony in support of this measure from the Hawaii Building and Construction Trades Council, AFL-CIO. The Department of Commerce and Consumer Affairs testified in opposition.
Your Committees believe that the intent of section 444-9.1, Hawaii Revised Statutes, is to protect the consumer, as it requires that all subcontractors who will perform work on a specific project be listed on the building permit along with their contractor's license number.
Your Committees find that it makes sense for each of the counties to enforce this law, as the counties already have primary responsibility for administration of the statute.
As affirmed by the records of votes of the members of your Committees on Transportation, Military Affairs and Government Operations and Tourism and Intergovernmental Affairs that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 914 and recommend that it pass Second Reading and be referred to the Committee on Ways and Means.
