Sir:
Your Committee on Judiciary, to which was referred S.B. No. 805 entitled:
"A BILL FOR AN ACT RELATING TO CONTROLLED SUBSTANCES,"
begs leave to report as follows:
The purpose of this measure is to allow the narcotics enforcement division to disclose investigative information to dispensers.
Your Committee received testimony in support of this measure from the Department of Public Safety (PSD). The Public Defender submitted comments on this measure.
According to testimony of the PSD, the statutory amendments contained in this measure are not necessary because only "registrants" can "dispense", and they are covered under current law. Registrants are certain licensed medical and dental professionals authorized to administer, prescribe, or dispense controlled substances.
Your Committee has amended this measure on the recommendation of the PSD by:
(1) Deleting references to dispensers; and
(2) Adding pharmacists employed by a registered pharmacy in this State that requests prescription information on a customer relating to a violation or possible violation of the controlled substances law.
As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 805, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 805, S.D. 1, and be placed on the calendar for Third Reading.
