Sir:

Your Committees on Labor and Tourism and Intergovernmental Affairs, to which was referred S.B. No. 797 entitled:

"A BILL FOR AN ACT RELATING TO PUBLIC SERVICE,"

beg leave to report as follows:

The purpose of this measure is to delete outdated references to repealed laws relating to loyalty oaths and to clarify a legislative body's subpoena powers.

Four members of the Maui County Council submitted testimony in support of the measure.

Your Committees find that chapter 85, Hawaii Revised Statutes, was repealed in 1993. However, certain statutory references, such as those in sections 78-8 and 78-9, Hawaii Revised Statutes, and contained in this measure, remain. Deleting these outdated provisions will eliminate any future confusion on the matter.

Similarly, the measure also contains an amendment to section 78-9, Hawaii Revised Statutes, that would more clearly assert a legislative body's power to compel a person to testify on matters pertaining to the government, property, or affairs of the State or of any political subdivision thereof, or the person's qualifications for public office or employment.

Your Committees believe that the amendments contained in the measure are necessary to avoid confusion and to clearly state the powers vested in the legislative branch of government.

As affirmed by the records of votes of the members of your Committees on Labor and Tourism and Intergovernmental Affairs that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 797 and recommend that it pass Second Reading and be referred to the Committee on Judiciary.
