Sir:

Your Committee on Judiciary, to which was referred S.B. No. 774, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO SMOKING,"

begs leave to report as follows:

The purpose of this measure is to prohibit smoking in all airport facilities except for specially designated enclosed areas.

Your Committee received testimony in favor of this measure from the Department of Health and an individual. Your Committee received testimony opposing this measure from the Department of Transportation.

Your Committee finds that protecting individuals from the dangers of involuntary exposure to environmental tobacco smoke is clearly in the public interest and is good public health policy. Airports present a highly dense environment that exposes thousands of travelers daily, both local and visiting, to environmental tobacco smoke and presents a greater danger to those individuals whose workplace is the airport.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 774, S.D. 1, and recommends that it pass Third Reading.
