Sir:

Your Committees on Transportation, Military Affairs and Government Operations and Economic Development and Technology, to which was referred S.B. No. 752 entitled:

"A BILL FOR AN ACT RELATING TO STATE BOATING FACILITIES,"

beg leave to report as follows:

The purpose of this measure is to clarify that leases issued for lands within small boat harbors and other state boating facilities may allow uses, other than maritime-related activities, that complement or support the maritime uses within the facilities.

Your Committees received testimony in support of this measure from the Board of Land and Natural Resources, the Ocean Tourism Coalition, Body Glove Cruises, Hawaii Government Employees Association, the Maritime Committee of the Hawaii Chamber of Commerce, and the Small Business Regulatory Review Board. Testimony in opposition was received from Hawaii's Thousand Friends, and a concerned citizen.

Your Committees find that our small boat harbors are in dire need of facility improvements, repair, and maintenance. Your Committees further find that needed repair and maintenance projects, and other improvements, have been deferred for years due to lack of funding.

Your Committees find that the State must continue to explore new sources of revenue for our small boat harbors, while protecting the public nature of the facilities. This measure would raise revenues, improve the facilities at our small boat harbors, and increase public enjoyment of the harbors through nonmaritime improvements.

Your Committees amended this bill to remove the provision allowing the board to lease submerged lands for private development. Your Committees find that submerged lands are ecologically fragile and should remain under the strict control and supervision of the State.

As affirmed by the records of votes of the members of your Committees on Transportation, Military Affairs and Government Operations and Economic Development and Technology that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 752, as amended herein, and recommend that it pass Second Reading in the form attached hereto as S.B. No. 752, S.D. 1, and be referred to the Committee on Ways and Means.
