Sir:
Your Committees on Agriculture and Tourism and Intergovernmental Affairs, to which was referred S.B. No. 643 entitled:
"A BILL FOR AN ACT RELATING TO DOGS,"
beg leave to report as follows:
The purpose of this measure is to authorize counties to enact and enforce ordinances relating to vicious dogs.
Your Committees received testimony supporting this measure from the City and County of Honolulu Department of the Prosecuting Attorney and Department of the Corporation Council, one member of the City Council, Hawaiian Humane Society, Kauai Humane Society, Hawaii State Association of Counties, and eight individuals.
Your Committees find that vicious dogs threaten the public safety and believe that county regulation provides the level of protection and recourse from dog attacks that the public desires and deserves. This measure clarifies that State laws shall not preempt county ordinances relating to dog attacks.
Your Committees have amended this measure by:
(1) Clarifying in the amendment to section 147-75, Hawaii Revised Statutes, that the county may enact and enforce ordinances regulating dog attacks on human beings not on an animal; and
(2) Changing the effective date to June 30, 2001.
As affirmed by the records of votes of the members of your Committees on Agriculture and Tourism and Intergovernmental Affairs that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 643, as amended herein, and recommend that it pass Second Reading in the form attached hereto as S.B. No. 643, S.D. 1, and be referred to the Committee on Judiciary.
